Program waiver
In consideration of child’s participation in ANTS After School LLC / dba ANTS Sports (“the Program”), I hereby waive, release, and discharge any and all claims for damages for personal injury, property damages or which may hereafter occur to my child as a result of their participation in said program. It is understood that at the program, children may participate in multiple recreational activities including hard-court sports, field sports, and playground structures. These recreational activities involve an element of risk or danger of accidents, and knowing those risks, I hereby assume those risks. This release is intended to discharge in advance the Program, its owners, officers, employees, volunteers, agents, and affiliated partners (“Released Parties”) from any and all liability, including liability arising from the ordinary negligence of the Released Parties, to the fullest extent permitted under California law. It is further understood and agreed that this waiver, release, and assumption of risk is to be binding on my heirs and assignees.
Authority of parent/guardian
I represent and warrant that I am the parent or legal guardian of the child being registered, and that I have full legal authority to execute this waiver, release of liability, and consent to treatment on behalf of the child.
I understand that this Agreement is binding on me, my child, and our heirs, assigns, and representatives to the fullest extent permitted by law.
Communications
By enrolling, I consent to receive critical program-related text messages (e.g., program orientation, reminders, weather updates, etc) from ANTS Sports at the number in my account. Msg & data rates may apply. Msg frequency varies. I can unsubscribe anytime by replying STOP, and I can reply HELP for help. See Privacy Policy for more details.
Use of third-party facilities and off-site activities
I understand that the Program may conduct activities at facilities and locations that are not owned or operated by the Program, including but not limited to public parks, playgrounds, school campuses, gyms, recreational fields, and other third-party premises (“Third-Party Facilities”). I acknowledge that the Program does not control the condition, maintenance, supervision, or safety of such Third-Party Facilities.
I further understand that participation in the Program may include supervised transitions between activity areas, including walking as a group to and from nearby fields, courts, playgrounds, or other designated spaces.
I acknowledge that injuries or accidents may occur during such activities or transitions, including but not limited to slips, falls, collisions, weather-related conditions, interactions with members of the public, or hazards associated with outdoor environments.
With full knowledge of these risks, I voluntarily assume all such risks and agree that this waiver and release of liability applies equally to any injury, illness, or damages occurring at or in connection with the use of Third-Party Facilities or during supervised walks, transitions, or off-site activities, to the fullest extent permitted by California law.
Concussion and serious injury risks
I understand that participation in athletic and recreational activities involves the risk of serious injury, including but not limited to sprains, fractures, head injuries, and concussions. I acknowledge that concussions and other traumatic brain injuries may occur even in non-contact sports or routine play, and may require immediate medical evaluation and ongoing care.
I understand that if my child shows signs of a concussion or other serious injury, the Program may remove my child from participation for safety reasons, and I may be required to obtain medical clearance before my child may return to activity.
Consent for treatment
I authorize the Program staff to provide basic first aid and to obtain emergency medical assistance for my child if, in the judgment of Program personnel, my child requires medical attention due to illness or injury during participation.
I understand that the Program may contact emergency medical services (911) if necessary, and that reasonable efforts will be made to notify the parent/guardian or emergency contact as soon as possible.
I acknowledge that I am solely responsible for any medical expenses incurred, and that the Program does not provide health or accident insurance coverage for participants. I agree to keep all medical information, allergies, and emergency contact information current in my registration account.
Child behavior and code of conduct
The Program strives to maintain a safe, positive, and inclusive environment for all participants. By enrolling, I agree to the following:
Standard of Conduct: My child agrees to follow the instructions of Program staff, show respect to other participants, and use equipment appropriately.
Zero Tolerance: Physical violence, bullying, harassment, or intentional destruction of property will not be tolerated.
Right of Removal: The Program reserves the right, in its sole discretion, to remove any child whose behavior is deemed dangerous, disruptive, or detrimental to the well-being of the group.
Refund Policy for Dismissal: In the event a child is dismissed from the program for behavioral reasons, I understand that no refunds or credits will be issued for the remaining portion of the session.
Parental Conduct: I agree to model positive sportsmanship and respect toward staff and other families. I understand that my own conduct may also impact my child’s eligibility to participate.
Consent for photography use
I agree that the Program (including its staff, employees and agents) can take and use photos and video recordings of the child/children named in this registration for the limited purposes of marketing the Program which may be publicly available on the internet, without compensational obligation, and I hereby release the Program (including its staff, employees and agents) from any Claims resulting from their use of photos and videos recordings. Note: If you wish to exclude your child from any such sharing, simply e-mail with us and we’ll respect your wishes!
Indemnification and hold harmless
I further agree to indemnify and hold harmless the Program and its associated parties from any and all claims, actions, suits, procedures, costs, expenses, damages, and liabilities, including attorney’s fees, brought as a result of my child’s involvement in the Program and to reimburse them for any such expenses incurred.
Severability
By signing this child up for the program, I further expressly agree that this waiver and assumption of risks agreement is intended to be as broad and inclusive as is permitted by the law of the State of California and that if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect.
Governing law and venue
This Agreement shall be governed by and construed in accordance with the laws of the State of California. Any dispute, claim, or legal action arising out of or relating to my child’s participation in the Program shall be brought exclusively in a court of competent jurisdiction located in the State of California, in the county in which the Program is operated.
Consent of parent/guardian
By checking the box below, I certify that I have read and understood the foregoing registration liability release and parental consent form, and agree to all of its terms and conditions. I give consent for my child to participate in the above program, and I execute the above liability release on my child’s behalf.
